Shutesbury Board of Selectmen September 25, 2008 Meeting Minutes Members present: Chairman Rebecca Torres, Ralph Armstrong and Al Springer. Also Present: Town Administrator David C. Dann and Administrative Secretary Leslie Bracebridge. Meeting opened at 7:00 P.M. Becky reported: * Selectmen received a letter from an attorney stating that his client would not be in attendance tonight. * Shutesbury’s Town Counsel has advised the Board of Selectmen that they meet in executive session for reason number 3: potential litigation. At 7:05 PM a roll call vote was taken to go into executive session for reason number 3: potential litigation. Springer – Aye, Armstrong – aye, Torres – Aye. At 8:15 PM Selectmen resumed open session. Selectman Springer reported on today’s drilling at the soil contamination site: Diagram attached. * This is a big problem – the insurance company says they won’t help out. Get an attorney to ask why the insurance company cannot help a town. Answer: Insurance is available at a prohibitive cost and Shutesbury does not have that insurance. * It will take 10 working days to get the results from the lab, and 4 to 5 weeks to get the Licensed Site Professional’s (LSP) report. * The LSP verbally advised Al that the town should o Get started running a new, separate, double-cased water line to 50 Leverett Road. o Tell The Conservation Commission the town has an emergency and that the town will put the soil right back in the same place it is removed from while running the new line. * The insurance company has advised the town not to remove the tank until the insurance company says it is OK. * Papers concerning tank removal need to be signed and returned to the Fire Chief right away. * These current actions are “phase one” and continue for 1 year. The town will have a total of 5 years to finish the project. * Cap the old water line to 50 Leverett RD rather than pull it up for less soil disturbance. David will need a site plan from the LSP in order to file a notice of intent with the Conservation Commission for an emergency permit to run a water line to 50 Leverett Road. He will ask the LSP if a straight line across the back of the field from the well to the back of the 50 Leverett Road property and then down to the house would be acceptable. Tap water tests will be conducted at 60 and 62 Leverett Road as it still has not been determined how far the contamination extends. Becky appreciates abutter and Attorney Michael Pill’s approach that he spoke of when he talked to Senator Rosenberg: “How do we find money to solve this problem?” Perhaps Attorney Pill can help the town find some resources. Selectman Springer reported on a meeting of the contractor, the local Clerk of the Works, the Town Administrator and himself at the dam this morning: * There is a need to send equipment onto the lake bed to make installation of the riprap stone easier. * A neighbor agreed that the town should let the contractor remove a tree at the contractor’s expense rather than wait until it’s a problem and then the town would have to pay for its removal.
